Pliny's celebration of Cicero's consular achievements contains a striking anomaly, namely the assertion that Cicero proscribed Marcus Antonius(HN7.117). That statement turns Cicero, the victim of Antonius’ murderous vendetta, into the one who wielded the executioner's axe, and it abruptly shifts the focus of the passage from 63 to 43b.c.Two slight corrections to the Latin text can eliminate the intrusion of the proscriptions by substituting a reference to the control Cicero exercised in 63 over Gaius Antonius, his (...) consular colleague and an old ally of Catiline. In hisIn Pisonem(§5), Cicero takes credit for combatting the threat posed by his colleague, and it is highly probable thatHN7.117 mentioned Gaius (not Marcus) Antonius as well, since Pliny's summary of Cicero's consular deeds and honours is nearly identical to the one found inPis. 4–6. The beauty of the emended text is that it restores both historical fact and a logical progression to the overall structure of Pliny's encomium. (shrink)

This note adduces three passages in Seneca the Elder to reinforce a demonstration in CQ 69, 793–8001 that the text of Plin. HN 7.117 has suffered corruption in one of its clauses and requires emendation to restore Pliny's intent. This additional evidence concerns a trope employed by declaimers which could have predisposed a scribe to alter Pliny's text to state that Cicero proscribed Mark Antony. Such a statement has no place in a list of achievements that otherwise all belong to (...) Cicero's consulship twenty years earlier in 63 b.c. (shrink)

This article is a discussion of Plin.Ep. 7.29 andEp. 8.6, in which he presents his reaction to seeing the grave monument of Marcus Antonius Pallas, the freedman and minister of the Emperor Claudius, beside the Via Tiburtina. The monument records a senatorial vote of thanks to Pallas, and Pliny expresses intense indignation at the Senate's subservience and at the power and influence wielded by a freedman. This article compares Pliny's letters with Tacitus’ account of the senatorial vote of (...) thanks to Pallas atAnn. 12.52–3 and explores the differences between the ways in which the two authors encourage readers to relate to past events. It is noted that the Pallas letters are unusual amongst Pliny's letters for their treatment of material unconnected with the life and career of Pliny and his friends, and argued that inEp. 7.29 Pliny uses language and attitudes drawn from satire to evoke the past.Ep. 8.6 is read as an idiosyncratic piece of historical enquiry, considering Pliny's use of citation and his anonymization of historical individuals. Both letters are considered in the context of the surrounding letters, and a hypothesis is offered regarding the identity of their addressee Montanus, considering evidence from Tacitus’HistoriesandAnnals. Discussion of Tac.Ann.12.52–3 focusses on the use of irony. Pliny's evocation ofenargeia(‘vividness’) is compared with that of Tacitus. Cleopatra VII, the last of the Ptolemaic rulers of Egypt, reveled in perfume (Plutarch, Life of Marcus Antonius 26.2). She even used it in her seduction of the Roman general Marc Antony. Sailing up the river Cydnus to meet him, she reclined in a canopy spangled with gold, adorned like Venus in a painting. Boys dressed as cupids fanned her and wondrous scents from incense offerings wafted along the riverbanks. Eli Hirsch recently suggested the metaontological doctrine of so-called "quantifier variance", according to which ontological disputes—e.g. concerning the question whether arbitrary, possibly scattered, mereological fusions exist, in the sense that these are recognised as objects proper in our ontology—can be defused as insubstantial. His proposal is that the meaning of the quanti er `there exists' varies in such debates: according to one opponent in this dispute, some existential statement claiming the existence of, e.g., a scattered object is true, according to (...) the other it is not. This paper argues that Hirsch's proposal leads into inconsistency. (shrink)

The theory of mind (ToM) deficit associated with autism has been a central topic in the debate about the modularity of the mind. Most involved in the debate about the explanation of the ToM deficit have failed to notice that autism’s status as a spectrum disorder has implications about which explanation is more plausible. In this paper, I argue that the shift from viewing autism as a unified syndrome to a spectrum disorder increases the plausibility of the explanation of the (...) ToM deficit that appeals to a domain-specific, higher-level ToM module. First, I discuss what it means to consider autism as a spectrum rather than as a unified disorder. Second, I argue for the plausibility of the modular explanation on the basis that autism is better considered as a spectrum disorder. Third, I respond to a potential challenge to my account from Philip Gerrans and Valerie Stone’s recent work (Gerrans, Biol Philos 17:305–321, 2002; Stone and Gerrans, Trends Cogn Sci 10:3–4, 2006a; Soc Neurosci 1:309–319, 2006b; Gerrans and Stone, Br J Philos Sci 59:121–141, 2008). In this paper, we consider one of the ways in which shared valuing is normatively significant. More specifically, we analyze the processes that can reliably provide normative grounding for the standing to rebuke others for their failures to treat something as valuable. Yet problems with grounding this normative standing quickly arise, as it is not immediately clear why shared valuing binds group members together in ways that can sustain the collective pursuit of shared ends. Responding to this difficulty is no (...) easy task, since doing so requires demonstrating that the standing to call on one's fellow participants because of shared forms of valuing is not merely a side effect of members authority to call on their fellow participants to do their fair share in a collective endeavor. This is, to the best of our knowledge, a problem that the sparse literature on shared valuing has yet to consider. We argue that the best way to address this difficulty is to consider the real‐world complexity of how forms of valuing come to be shared within well‐structured collectives and how members internalize the evaluative tendencies that sustain shared valuing. To accomplish those ends, we examine two different ways that shared valuing is cultivated within well‐structured groups and the corresponding ways that members internalize forms of valuing; specifically, we examine differences between forms of valuing that are passed downward from the top of a group, as they are in the U.S. Military, and forms of valuing that bubble‐up through local patterns of interaction, as they do among the Zapatistas of Chiapas. The ‘Introduction’ to Naturrecht Feyerabend is the transcript of a lecture Kant held at the very time he began writing the Groundwork. It contains the first securely dated occurrence of the term ‘autonomy’ (and its first occurrence in the context of moral philosophy) in Kant’s work. It argues that moral imperatives are categorical and asks how they are possible. Kant’s attempts to answer this question circle around the idea that freedom must be ‘a law to itself’ and lead him to (...) the claim that the form of universal lawfulness, independently of any inclination, can determine the will. Thus various central elements of the Groundwork conception of autonomy are already present in this text. Other elements, most notably the universal law formulation of the categorical imperative and the emphasis on reason as both source and addressee of moral commands, are conspicuously absent. Following a reconstruction of Kant’s overall argument for autonomy of the will in the notes, the paper offers a detailed interpretation of central passages concerning autonomy in order to identify both similarities and differences between the conceptions of autonomy in the ‘Introduction’ and in the Groundwork. Peer review is often taken to be the main form of quality control on academic research. Usually journals carry this out. However, parts of maths and physics appear to have a parallel, crowd-sourced model of peer review, where papers are posted on the arXiv to be publicly discussed. In this paper we argue that crowd-sourced peer review is likely to do better than journal-solicited peer review at sorting papers by quality. Our argument rests on two key claims. First, crowd-sourced peer (...) review will lead on average to more reviewers per paper than journal-solicited peer review. Second, due to the wisdom of the crowds, more reviewers will tend to make better judgments than fewer. We make the second claim precise by looking at the Condorcet Jury Theorem as well as two related jury theorems developed specifically to apply to peer review. (shrink)

An engaging new translation of a timeless masterpiece about coping with the death of a loved one In 45 BCE, the Roman statesman Cicero fell to pieces when his beloved daughter, Tullia, died from complications of childbirth. Abstract The current accountability system for private military and security contractors (PMSCs) is woefully inadequate, and mere enhancements in oversight cannot hope to remedy that failing. I contend that once we recognize the kind of accountability required of PMSCs, we will realize that radical changes in the foundational relationship between PMSCs and the state are required. More specifically, in order to be appropriately accountable, members of PMSCs must become a part of or, at the very least, directly responsible to the (...) legitimate authoritative military or police structures, and there must be a clear and precise delineation of responsibility among public officials for holding individual members of PMSCs criminally liable. This book challenges the conventional wisdom that improving democratic politics requires keeping emotion out of it. Marcus advances the provocative claim that the tradition in democratic theory of treating emotion and reason as hostile opposites is misguided and leads contemporary theorists to misdiagnose the current state of American democracy. Instead of viewing the presence of emotion in politics as a failure of rationality and therefore as a failure of citizenship, Marcus argues, democratic theorists need to understand that emotions (...) are in fact a prerequisite for the exercise of reason and thus essential for rational democratic deliberation and political judgment. Attempts to purge emotion from public life not only are destined to fail, but ultimately would rob democracies of a key source of revitalization and change. Drawing on recent research in neuroscience, Marcus shows how emotion functions generally and what role it plays in politics. In contrast to the traditional view of emotion as a form of agitation associated with belief, neuroscience reveals it to be generated by brain systems that operate largely outside of awareness. Two of these systems, "disposition" and "surveillance," are especially important in enabling emotions to produce habits, which often serve a positive function in democratic societies. But anxiety, also a preconscious emotion, is crucial to democratic politics as well because it can inhibit or disable habits and thus clear a space for the conscious use of reason and deliberation. If we acknowledge how emotion facilitates reason and is "cooperatively entangled" with it, Marcus concludes, then we should recognize sentimental citizens as the only citizens really capable of exercising political judgment and of putting their decisions into action. The goal of this paper is to describe the link between financial performance and the level of sustainability. In a novel approach, the paper classifies firms based on past financial success to address a potentially reciprocal relationship. For the groups of better and worse performing firms and for the entire sample, the above link is then tested, also accounting for non-linearity in the relationship. We show that environmental management system (EMS) implementation as a proxy for a firm's sustainability level is (...) only positively associated with the financial performance of financially well-performing firms. Conversely, it has a negative association with the performance of less good firms. We show that this implies that firms cannot change from good to bad performance, and vice versa, solely through the implementation of an EMS, and also that the result remains when introducing non-linearity in the link. Based on this result, we discuss implications for the direction of causality. (shrink)

Deep brain stimulation is an invasive technique designed to stimulate certain deep brain regions for therapeutic purposes and is currently used mainly in patients with neurodegenerative disorders, such as Parkinson’s disease. However, DBS is also used increasingly for other experimental applications, such as the treatment of psychiatric disorders, weight reduction. Apart from its therapeutic potential, DBS can cause severe adverse effects, some that might also have a significant impact on the patient’s personality and autonomy by the external stimulation of DBS (...) which effects lie beyond the individual’s control and free will. The article’s purpose is to outline the procedures of DBS currently used in therapeutic and experimental applications and to discuss the ethical concerns regarding this procedure. It will address the clinical benefit-risk-ratio, the particular ethics of research in this field, and the ethical issues raised by affecting a patient’s or an individual’s personality and autonomous behaviour. Moreover, a potential ethical guideline, the Ulysses contract is discussed for the field of clinical application as well as the question of responsibility. (shrink)

By digging through the stratigraphy of the history of ideas we can find within and beyond Marxism an 'aleatory current' that values the role of chance in history. Using this perspective, the book builds a case for a historical materialism that is stripped of all teleology. Starting in the ancient Mediterranean with Epicurus, it traces the history of conceiving history as plural up to Marxism and modern science. It shows that concrete historical 'worlds' such as ancient Mesoamerica and Eurasia cannot (...) be reduced to a single template. Affirming the potentiality of a future non-capitalist 'world', it invalidates any 'end of history' thesis. (shrink)

Although most styles of military ethics are hybrids that draw on multiple ethical theories, they are usually based primarily on the model of Aristotelian virtue ethics. Virtue ethics is well-suited for regulating the conduct of soldiers who have to make quick decisions on the battlefield, but its applicability to military personnel is threatened by the growing use of unmanned weapon systems. These weapons disrupt virtue ethics’ institutional and cultural basis by changing what it means to display virtue and transforming the (...) roles soldiers perform and the nature of the military profession itself. I argue that in light of these challenges to virtue ethics, at least as it is traditionally understood within the armed forces, soldiers operating unmanned weapons require a more heavily rule-based approach to military ethics. The paper discusses legal implications of the expansion of practical uses of mathematics in social life. Taking as a starting point the omnipresence of mathematical infrastructures underlying policies, technology and markets, the paper proceeds by attending to relevant materials offered by general philosophy, legal philosophy, and the history and philosophy of mathematics. The paper suggests that the modern transformation of mathematics and its practical applications have spurred the emergence of multiple useful technologies and forms of social interaction but have impoverished (...) access to meanings originating in the lifeworld. The paper also argues that, as part of devices of interest aggregation and expert networks, mathematical infrastructures can be scrutinized by a revised form of legal practice that subjects them to legal critique and reconstruction in order to overcome conditions that have eroded the moral self-awareness of individuals and communities and their existential meanings.
